Introduction to Pakistan’s ADR Ecosystem

Introduction to ADR and Pakistan’s ADR Ecosystem (in the context of global adr movement)

It is imperative for law students, policy professionals and corporate leaders to understand the changing dynamics of dispute resolution in Pakistan. With court pendency increasing by the day, and along with it, the average time taken to resolve a case, alternative means of dispute resolution are essential to provide expedient and expeditious justice.

Pakistan has made considerable progress on the ADR front. Apart from the more commonly known Arbitration Act of 1940, all provinces now have distinct Alternative Dispute Resolution laws which have enabled mediation, negotiation and conciliation to be provided formal legal cover along with judicial enforceability. In the context of these laws, ADR ecosystems, though nascent, have developed across all provinces providing an opportunity to disputing parties to resolve their disputes using means other than arbitration and litigation. The knowledge of the ADR ecosystem, its shortcomings and opportunities, is essential for all stakeholders and individuals involved in the commercial, legal and development/public policy domains.

This course will provide an in-depth understanding of Pakistan’s ADR ecosystem in the context of global developments in ADR (comparative analysis) and will enable participants to explore how they and their organizations can benefit from or contribute to ADR in Pakistan
